Daiso Privacy Policy

1. Introduction and Scope

This Privacy Policy (this “Policy”) explains how Daiso USA LLC (“Daiso,” “we,” or “us”) collects, uses, discloses, and protects Personal Information of consumers in the United States. This Policy is incorporated into and made a part of the Terms of Service available at https://daisous.com/policies/terms-of-service (the “Terms of Service”). This Policy applies to information collected through https://daisous.com (the “Website”), through in-person point-of-sale (“POS”) terminals at Daiso retail stores, and through other interactions described in this Policy. This Policy applies to information we collect through the Website; in communications, including email, text, chat, and other electronic messages, between you and Daiso or the Website; when you make purchases or otherwise interact with us at in-person POS terminals; and when you interact with our advertising on third-party websites and services that include links to this Policy.

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked with an identifiable individual. Capitalized terms used but not defined in this Policy have the meanings given to them in the Terms of Service.

This Policy does not apply to information collected by any third party, including through any application, content, website, or service operated by a third party that does not link to this Policy. Except for information collected at in-person POS terminals as described in this Policy, this Policy does not apply to information collected by us offline or through means not described in this Policy.

We do not sell Personal Information for monetary consideration. We may disclose Personal Information to service providers and contractors that perform analytics, marketing, payment processing, and other services on our behalf, including vendors paid to analyze customer data to improve customer reach. These vendors may use Personal Information only for the limited purpose of providing those services to Daiso and not for their own independent purposes. Where we use advertising or analytics technologies that constitute “sharing” under applicable law, California residents may opt out of such sharing as described below.

Please read this Policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with the Website or providing us with your information, you agree to the collection, use, and sharing of your information as described in this Policy. This Policy may change from time to time, see Section 11 (Changes to this Policy and Accessibility). Your continued use of the Website after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates. This Policy should be read together with our Terms of Service, which govern your use of the Website and into which this Policy is incorporated by reference.

2. Personal Information We Collect

2.1 Categories of Personal Information

Depending on how you interact with Daiso, including online or at in-person POS terminals, we may collect the following categories of Personal Information, where applicable and permitted by law:

·         Identifiers, such as name, alias, mailing address, email address, phone number, customer account identifiers, or any other contact information you provide us.

·         Online identifiers and device information, such as Internet Protocol (IP) address, cookies, device identifiers, beacons, pixel tags, mobile ad identifiers, or other similar technology, or other forms of persistent or probabilistic identifiers that can be used to identify a particular consumer or device.

·         Commercial information, such as purchase history, records of products or services considered; other purchasing or consuming histories or tendencies; and other commercial information.

·         Internet or network activity information, such as browsing history, search history, and information regarding your interactions with the Website, advertisements, or applications. This category does not include the technical identifiers (such as IP addresses or device identifiers) used to collect such activity information, which are addressed separately under “Online identifiers and device information” above.

·         Data related to ecommerce and in-person transactions, such as payment information, purchase history, and POS transaction information. Some information, such as payment information, is directly collected or processed by our third-party payment processors.

·         Geolocation data, limited to approximate location derived from IP address estimation that typically resolves at most to the city or town level. We do not collect precise geolocation data.

·         Demographic information, including age, gender, occupation, professional and employment-related information, and interests, if you have consented to such information collection.

·         Inferences drawn from the above to improve customer experience or to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

2.2 Sensitive Personal Information

Daiso does not intentionally collect Sensitive Personal Information (as provided under applicable state privacy laws), such as Social Security numbers, passport numbers, genetic data, or precise geolocation data from consumers. Please do not provide Sensitive Personal Information through the Website or at in-person POS terminals.

2.3 Statistical and Technical Information

In addition to the categories of Personal Information above, we may also collect the following types of statistical and technical information:

·         Statistics or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from Personal Information. For example, we may aggregate Personal Information to calculate the percentage of users accessing a specific Website feature or aggregate POS transaction information to understand customer reach and general customer location by ZIP code.

·         Technical information. Technical information includes information about your internet connection and usage details about your interactions with the Website, such as clickstream information to, through, and from the Website (including date and time), products that you view or search for; page response times, download errors, length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), or methods used to browse away from a page.

If we combine or connect non-personal statistical or technical data with Personal Information so that it directly or indirectly identifies an individual, we treat the combined information as Personal Information.

3. How We Collect Personal Information

3.1 Information You Provide

We collect Personal Information:

·         From you directly, such as when you sign up for our email newsletter, make a purchase through the Website or at an in-person POS terminal, or contact us with inquiries.

3.2 Third-Party Sources

We may also collect Personal Information from sources other than you, including:

·         From our affiliates and service providers.

·         Automatically through devices, systems, and services you use to access the Website or interact with in-person POS terminals as further described below. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including details of your interactions with the Website, such as traffic data, location data, logs, and other communication data, and usage data.

·         From advertising and analytics partners, such as Google, Meta Pixel, Pinterest, and Shopify. These third parties may use tracking technologies to collect information about you when you use the Website. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites, apps, platforms, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

o    Google Analytics. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. As configured for our Website, location information from Google Analytics is derived entirely from IP address estimation and typically resolves at most to the city or town level; we do not use Google Analytics to collect precise geolocation data. Google uses the data collected to track and monitor the use of our service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. o    Meta Pixel. We use Meta Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior to be tracked after you have been redirected to our Website by clicking on the Facebook ad. The Meta Pixel stores a cookie on your device to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes. We do not have access to the information collected through the Meta Pixel. However, the information collected via the Meta Pixel is also stored and processed by Facebook. Facebook may link this information to your Facebook account and also use it for its own promotional purposes in accordance with Facebook’s Data Usage Policy. The Meta Pixel also allows Facebook and its partners to show you advertisements on and outside of Facebook. You can opt-out of displaying Facebook ads by visiting your Facebook Ad Settings, and you can clear and control the information third parties share with Facebook in your Off-Facebook Activity page. 3.3 Automatic Collection (Cookies, Tracking, and Analytics)

We may use these automatic collection technologies to collect information about your online activities over time and across third-party sites or other online services (behavioral tracking).

Using automatic collection technologies helps us to improve the Website and to deliver a better and more personalized experience. For more information about how to manage tracking methods on the Website, see the Your Rights and Choices About Your Information section below.

The technologies we use for this automatic data collection may include:

·         Cookies. A cookie is a small file placed on your device when you interact with the Website. You may refuse to accept or disable cookies by activating the appropriate setting on your browser or device. However, if you select this setting, you may be unable to access certain features of the Website.

·         Web Beacons. Some parts of the Website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Daiso, for example, to count users who have visited those parts or opened an email and for other related statistics (for example, recording the popularity of certain content and verifying system and server integrity).

·         We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

To the extent any of these automated technologies are considered a sale of Personal Information, targeted advertising, or profiling, under applicable laws, depending on where you live, you may opt out from use of these automated technologies for such uses as described in this Policy. Please note that some Website features may be unavailable as a result.

3.4 Chat Technologies

We may also use chat technologies, such as chatbots, operated by third party vendors that enable the chat features that you can use to communicate with us through the website. Daiso and these vendors may monitor and record information you share through these chat features and collect information about your interaction with them and your device (e.g., IP address, online identifiers), for quality assurance, analytics and the other purposes described in this Policy. PLEASE DO NOT SUBMIT SENSITIVE PERSONAL INFORMATION INTO CHATBOTS.

4. How We Use Personal Information

We use Personal Information for the following business purposes:

·         Provide you with the Website and any content, features, information, products, or services that we make available through the Website or in-person retail interactions.

·         Processing online and in-person transactions and providing offers, products, and services.

·         Customer support and communications, including responding to inquiries or requests.

·         Website functionality and analytics.

·         Marketing and advertising, including interest-based advertising where permitted, and sending newsletters and marketing communications.

·         For legal compliance and internal policy enforcement.

·         To fulfill any other purpose for which you provide it, including as described when you provide the information.

·         For any other purpose with your consent.

5. How We Share Personal Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose Personal Information:

·         To service providers and contractors performing services on our behalf.

·         To advertising and analytics partners.

·         To our affiliates and subsidiaries.

·         To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Daiso’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Daiso is among the assets transferred.

·         To government authorities when required by law.

·         For any purpose disclosed to you when you provide the information.

·         With your consent.

5.1 Cross-Context Behavioral Advertising

We may share Personal Information for cross-context behavioral advertising as described in this Policy. We do not share Sensitive Personal Information for this purpose, and our paid vendors that analyze customer data to improve customer reach act as service providers or contractors and may use that data only for that limited purpose. We work with third-party advertising and analytics providers that use cookies, tracking pixels and similar technologies to help measure customer conversion tracking, advertising performance, deliver relevant advertisements, and analyze interactions across the internet. These providers may collect information about your interactions over time and across different websites or online services. Examples of these providers include advertising platforms, social media networks and analytics services. You may opt out of this data collection by employing industry opt-out tools such as the Digital Advertising Alliance’s opt-out page (www.aboutads.info/choices) or by adjusting your device, browser or account advertising settings with the applicable third-party platforms.

6. Your Privacy Rights and Choices

This section describes mechanisms you can use to control certain uses and disclosures of your information. You have the following options to manage advertising preferences and tracking:

·         Cookie Banner. If you use our cookie consent banner to exercise your privacy rights, the opt out signal will be applied to your browser.

·         GPC Signals. Daiso honors Global Privacy Control (GPC) signals as a valid request to opt out of the sale or sharing of personal information where required by law.

·         Browser Settings. You can configure your browser to refuse or alert you to cookies and other tracking technologies and to opt out of other tracking methods. Disabling cookies may affect Website functionality. Our Website may not respond to all “Do Not Track” (DNT) browser signals due to varying interpretations of the DNT standard; however, you may use the cookie and advertising controls described in this Policy to manage data collection and use.

·         Contacting Daiso. If you do not wish us to use, disclose, or otherwise process any information that we collect or that you provide to us for any commercial, promotional, advertising, or marketing purposes, you may opt out by contacting us using the information provided in the Contact Us section below and we may honor your request in accordance with applicable law.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. 7. Data Retention

We retain Personal Information for as long as the e-commerce store remains active to provide services, process orders, and handle back-end operations, unless a longer retention period is required or permitted by law.

8. Security

We implement administrative, technical, and physical safeguards designed to protect your Personal Information from unauthorized access, use, alteration, and disclosure. Our technical safeguards may include 256-bit SSL encryption to help protect data transmitted to and from the Website. Payment information is processed through our payment processor’s PCI-compliant servers, which adhere to Payment Card Industry Data Security Standards. While we strive to protect your Personal Information, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee the absolute security of your information.

9. Consumer Rights (Access, Delete, Correct, Opt-Out)

Depending on your state of residency, you may have the right to:

·         Access Personal Information we hold about you

·         Request deletion of certain Personal Information

·         Request correction of inaccurate Personal Information

·         Opt out of targeted advertising or sharing of Personal Information

·         Receive Personal Information in a portable and, to the extent technically feasible, readily usable format

Important: The exact scope of these rights varies by state. There are also several exceptions where we may not have an obligation to fulfill your request.

9.1 How to Exercise Rights

To exercise any of these rights, please send an email to legal@daiso-usa.com. We will respond to verifiable consumer requests in accordance with applicable law.

9.2 Verification Process

We may ask you to verify your identity before fulfilling your request. We will verify your identity either to a reasonable degree of certainty or a reasonably high degree of certainty depending on the sensitivity of the Personal Information and the risk of harm to you.

9.3 Appeals

If we deny your request, you may have the right to appeal and can do so by contacting legal@daiso-usa.com. We will respond to appeals within the timeframe required by applicable law.

9.4 Non-Discrimination

We will not discriminate against you for exercising your privacy rights.

10. Children’s Privacy

Daiso’s Website, services, and in-person retail operations are not directed to children under 13, and we do not knowingly collect or retain Personal Information from children under 13. We also do not knowingly sell or share Personal Information of consumers under 16 where applicable under state law. If we learn that we have collected or retained Personal Information from a child under 13, or from a consumer under 16 in circumstances requiring consent under applicable state law, without any required verifiable parental consent or other legally required authorization, we will delete the information. If you know or have reason to believe we have collected such information, please contact us using the information in the Contact Us section below.

11. Changes to This Policy and Accessibility

We may update this Policy from time to time, and we will provide notice of any such changes to the Policy as required by law. The date the Privacy Policy was last updated is identified at the top of the page. We will notify you of changes to this Policy by updating the “last updated” date and posting the updated policy on the Website. We may email or otherwise communicate reminders about this Policy, but you should check our Website periodically to see the current policy and any changes we have made to it.

13. Supplemental Notice for California Residents

The California Consumer Privacy Act, as amended by the California Privacy Rights Act of 2020 (“CCPA”), requires that we provide California residents with certain additional disclosures. This section supplements the information provided elsewhere in this Policy and is intended solely for California residents. The categories of Personal Information we collect, our sources, our purposes for use, and the parties with whom we share Personal Information are described in Sections 2 through 5 above.

13.1 California-Specific Definitions

The CCPA defines “personal information” to mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. Personal information does not include publicly available, deidentified or aggregated information or lawfully obtained, truthful information that is a matter of public concern.

For a detailed description of the categories of Personal Information we collect, please see Section 2 (Personal Information We Collect) above. In the 12 months prior to the Last Updated Date of this Policy, we may have collected all categories described in that section.

For a detailed description of our sources of Personal Information, please see Section 3 (How We Collect Personal Information) above. We do not collect all categories of Personal Information from each source.

13.2 Sale, Sharing, and Disclosure of Personal Information

In the 12 months preceding the Last Updated Date of this Policy, we have not sold Personal Information for monetary consideration. We may have shared Personal Information for cross-context behavioral advertising through Website advertising and analytics technologies, where permitted by law, and we may have disclosed Personal Information to affiliates, vendors, service providers, contractors, marketing, research, and analytics partners for business purposes. Paid vendors that analyze customer data to improve customer reach are service providers or contractors and may use the data only for that limited purpose.

We may have shared Personal Information, where applicable, for the business and commercial purposes described in Section 4 (How We Use Personal Information) and Section 5 (How We Share Personal Information) above. We do not permit service providers or contractors that receive Personal Information from us to use that information for their own independent purposes.

In addition, we may have disclosed Personal Information for a business purpose to the following categories of recipients: our affiliates, vendors, service providers, contractors, and marketing providers. For a description of the categories of Personal Information we may have disclosed, please see Section 2 (Personal Information We Collect) above.

We do not knowingly collect or retain Personal Information from children under 13, and we do not knowingly sell or share the Personal Information of consumers under 16 where applicable under state law. We do not use or disclose Sensitive Personal Information for purposes other than those allowed by the CCPA and its regulations. Because we do not use Sensitive Personal Information for secondary purposes that would trigger the right to limit, a “Limit the Use of My Sensitive Personal Information” link is not required.

13.4 Your California Privacy Rights

If you are a California resident, you have the following rights with respect to your Personal Information:

1.      The right to know what Personal Information we have collected about you, including the categories of Personal Information, the categories of sources from which we collected Personal Information, the business or commercial purpose for collecting, selling, or sharing Personal Information (if applicable), the categories of third parties to whom we disclose Personal Information (if applicable), and the specific pieces of Personal Information we collected about you. When you request specific pieces of Personal Information, we will provide that information in a portable and, to the extent technically feasible, readily usable format;

2.      The right to delete Personal Information that we collected from you, subject to certain exceptions;

3.      The right to correct inaccurate Personal Information that we maintain about you;

4.      If we sell or share Personal Information, the right to opt out of the sale or sharing;

5.      If we use or disclose Sensitive Personal Information for purposes other than those allowed by the CCPA and its regulations, the right to limit our use or disclosure; and

6.      The right not to receive discriminatory treatment by us for the exercise of privacy rights the CCPA confers.

13.5 How to Submit a Request to Know, Delete, and/or Correct

You may submit a request to know, delete, and/or correct by sending an email to legal@daiso-usa.com.

If you submit a request to delete, you may be asked to confirm separately that you want your Personal Information deleted.

If you are submitting a request on behalf of a California resident, please submit the request through the designated method discussed above. After submitting the request, we will require additional information to verify your authority to act on behalf of the California resident, including (i) a copy of the consumer’s signed, written authorization designating you as an authorized agent, and (ii) verification of your own identity. If you have a valid power of attorney under California Probate Code sections 4121 to 4130, we may require you to provide proof of that power of attorney. If an authorized agent submits a request without providing proof of authorization, we may ask the consumer to verify their identity directly with us or confirm authorization.

13.6 Verification Process

We will comply with your request upon verification of your identity and, to the extent applicable, the identity of the California resident on whose behalf you are making such request.

We will verify your identity either to a “reasonable degree of certainty” or a “reasonably high degree of certainty” depending on the sensitivity of the Personal Information and the risk of harm to you by unauthorized disclosure, deletion, or correction as applicable. To do so, we will ask you to verify data points based on information we have in our records concerning you.

13.7 Right to Opt Out of Sale or Sharing

If you are a California resident, you have the right to direct us to stop selling or sharing your Personal Information.

You may submit a request to opt out of sales or sharing by (i) sending an email to legal@daiso-usa.com or (ii) enabling a privacy control on your browser, such as the Global Privacy Control (GPC), which we will treat as a valid request to opt out. Please see Section 6 (Your Privacy Rights and Choices) above for more information.

13.8 Shine the Light Law

If you are a California resident, California Civil Code § 1798.83 permits you to request information regarding the disclosure of your personal information by us to third parties for the third parties’ direct marketing purposes (as those terms are defined in that statute).
